General Terms and Conditions for Participation in the #ZWF Digital Selection 2021

1. GENERAL

The Zurich Wine Festival Digital Selection (or ZWF Digital Selection) is part of the Zurich Wine Festival, which is organised by the Association Zurich Wine Festival (hereafter referred to as "Organiser").

With the ZWF Digital Selection, the Organiser aims to support small wine producers from all over the world.

By registering for the ZWF Digital Selection, the participant (hereafter referred to as "Participant") accepts the following Regulations on behalf of him/herself and any other person who may also participate.

2. CONDITIONS OF PARTICIPATION

The contest is open to all wine producers that produce less than 100,000 wine bottles per year. Participation is not bound to a particular domicile.

2.1 REGISTRATION

Registration for the ZWF Digital Selection is only possible until April 30, 2021, at 23:59 (Central European Time) via digital.zurichwinefestival.com.

A ZWF account is necessary for registration. All participants are obliged to complete the registration form completely and truthfully.

Registration for the ZWF digital selection does not imply a warranty that the Zurich Wine Festival will actually take place.

2.2 CONTACT PERSON AND CREW

There is one ZWF account per wine producer/crew/submission assigned to the name of the registered person. All communication will take place between the Organiser and the registered Participant only. The registered person alone is entitled to accept a possible prize.

Participants must be able to provide proof of identity in the form of a copy of their National Identity Card or comparable document (passport, registration certificate) if requested by the Organiser.

2.3 EXCLUSION FROM THE CONTEST

The Organiser reserves the right to exclude from the contest Participants who breach the ZWF Digital Selection Regulations. Participants who attempt to disrupt the course of or manipulate the contest will also be excluded from participation.

3. VIDEOS

3.1 SUBMISSION

In order to submit a video, every participant must upload his/her video file to the submission form at digital.zurichwinefestival.com. Participants can upload their videos using one of the following file formats: mov, mp4, avi, wmv, and other formats supported by Youtube.

Only one entry can be submitted per ZWF account and wine producer.

3.2 FORMAL REGULATIONS

Videos may be submitted to the ZWF Digital Selection. A video entry participates in the contest if it is not longer than 2 minutes and is received before the entry deadline. The video may be in any language. If the film is not in English, subtitles in this language are required.

3.3 PRESENTATION AT ZWF DIGITAL SELECTION AND ONLINE VOTING

Providing they do not breach the conditions, the videos will be linked to the YouTube channel of the Zurich Wine Festival and embedded to the ZWF Digital Selection website where they will compete for the award. The public can rate each of the videos on a scale of 1 to 5 via a public online voting system to be held from May 3 to 16, 2021. The 3 videos with the highest number of points receive the award.

4. PRIZES

Three prizes will be given. The 3 winners will be announced on June 1st 2021. The Organiser is under no circumstances obliged to pay travel or accommodation expenses for the participants nor expenses resulting from the wines' shipping.

The winners are the 3 videos that receive the highest number of points at the end of the online voting period at digital.zurichwinefestival.com. In the event of a tie, the winner will be drawn by lot without possibility of recourse to legal action.

If a winner forfeits his/her prize, he/she will be replaced by the next participant with the majority of votes.

The prize for each winner comprises:
1 Spot at the ZWF digital selection 2021 booth, shared with the two other winners.
2 Industry passes.
2 Invitations to the Gala & Award dinner.

5. GRANT OF RIGHTS

5.1 TRANSFERRAL OF RIGHTS TO THE ORGANISER

The Participant maintains the rights to his/her video entry at all times. However, he/she grants the Organiser the right to present the submitted video, make it publicly available, distribute it and make it available for third party viewing unrestrictedly in terms of location and frequency. The Participant agrees to his/her video being used for advertising purposes.

Furthermore, the Participant expressly agrees to his/her video being made public via the digital.zurichwinefestival.com website and the Zurich Wine Festival YouTube channel. If applicable, the Organiser and its sponsors will refer to, create links to or embed the video in various publications or on the Internet.

The Organiser is not the provider of the video submitted by the participants. These videos will be made available exclusively by the respective user.

5.2 THIRD PARTY DECLARATION OF CONSENT

By submitting a video, the Participant declares that he/she owns all rights (including all third-party rights) with regard to the submitted video. In the event that one or more persons are clearly recognisable, or the sound or music of third parties can be heard in the video, those involved must agree that the video is made public. The respective declaration of consent must be made available if requested by the Organiser.

Should third parties nevertheless assert claims resulting from the infringement of their rights, the Participant declares the Organiser free from all said claims. The person who submits the video is solely responsible for its content (image, sound, data, texts etc.).

5.3 MUSIC RIGHTS

You must seek approval from SUISA before using another person’s music. SUISA-free music may also be used. In this case, the Participant must provide evidence if requested by the Organiser that the respective piece of music is SUISA-free. The Participant declares the Organiser free from all responsibilities regarding charges brought forward by SUISA and/or other collecting societies in relation to the film created by that Participant.

5.4 RIGHTS TO ONE'S OWN PICTURE

By participating, the Participant agrees to photographs and recordings being made of his/her person throughout the contest process – particularly during the Zurich Wine Festival – and those photographs and recordings to be published at zurichwinefestival.com as well as on the Organiser’s Facebook page and in other publications. Furthermore, the Participant also agrees to his/her name being published at zurichwinefestival.com as well as on the Organiser’s Facebook page and in other publications. The Participant also understands that his/her name may be published in connection with his/her photograph.

6. OBLIGATIONS WITH REGARD TO THE FESTIVAL

Once announced as a winner, the participant takes on obligations as an exhibitor of the Zurich Wine Festival.

Exhibitors are obliged to have their stands set up properly with wine exhibits and attended by staff throughout the opening hours of the festival.

The Organiser shall give exhibitors the opportunity, by arrangement, to set up the exhibits 2 hours before the event.

Every exhibitor will receive 2 industry passes, free of charge. These passes are exclusively for the exhibitor, his/her stand staff and representatives. In the case of misuse, the passes will be withdrawn without replacement.

The exhibitor contract shall end, as a general rule, with the end of the trade fair. Immediately after the end of the fair, exhibitors shall completely vacate the stand and return it in the same condition in which they received it; all exhibits and any other objects they may have brought to the stand must be removed.

7. CANCELLATION OF THE FESTIVAL

Association Zurich Wine Festival has the right to postpone, curtail, extend, temporarily close, partially or completely, or cancel the trade fair, should it be necessary, for reasons beyond their control, and taking into consideration the interests of the participants in so doing. In such justifiable, exceptional circumstances, as in all cases of force majeure, exhibitors shall not be entitled to rescind their contract nor claim damages.

8. INSURANCE

The exhibitor shall be responsible for obtaining insurance cover for all exhibits and additional equipment, in particular against damage, theft etc., during transportation and during the event. The organiser shall not bear any insurance risk of the exhibitor. The exhibitor is responsible for providing sufficient insurance cover for his/her own liability. The exhibitor is liable for damages incurred by third parties employed by or acting on behalf of the exhibitor in the same way as those of his/her own making.

9. LIABILITY

Claims for damages with regard to ZWF Digital contest against the Organiser are – to the extent legally permissible – excluded, irrespective of legal grounds.

Furthermore, the Organiser is not liable for damages resulting from the lack of availability of the Internet sites necessary for the contest (YouTube.com and digital.zurichwinefestival.com). This applies to technical faults outside the Organiser's field of influence, force majeure and attacks on these Internet sites by third parties. Furthermore, the Organiser accepts no responsibility for any of the Internet sites working properly on any Participant’s computer.

10. FINAL PROVISIONS

Should a clause in these regulations be invalid or a legal loophole exists, the validity of the remaining clauses or the regulations as a whole remain unaffected. In the above-mentioned event, the missing or invalid clause shall be replaced by a valid clause that comes closest to the intended sense and purpose of the invalid or missing clause. The Organiser reserves the right to make decisions on all matters unforeseen by these regulations and, in special, vindicated cases, to make exceptions to these regulations.

Swiss law is solely applicable in the event of disputes. The place of jurisdiction is – to the extent legally permissible – agreed upon as where the Organiser is based. For participants whose place of general jurisdiction is not Switzerland, or reside abroad after entering the contest, the place of jurisdiction shall also be agreed upon as where the Organiser is based.

The laws of the Swiss Confederation apply. Any recourse to legal action is excluded.
